1. General conditions

All programmes offered are led by local, German- or English-speaking guides. Customers must be ready in the hotel lobby at the stated pick-up times. If a customer is more than 30 minutes late, the operator is entitled to withdraw from running the programme and to charge the standard cancellation fee for no-shows. The programmes include the services stated in the description, including entrance fees and parking charges.

2. Conclusion of the booking contract / registration

With the registration, the customer makes a binding offer to PT. BaliChakra Bhuwana Agung, operator of balivwtour.com (hereinafter "the operator"), to conclude a booking contract. Anyone registering on behalf of several participants is liable for their contractual obligations as for their own. The contract comes into effect upon acceptance by the operator. The customer receives a written booking confirmation and preliminary invoice with or immediately after conclusion of the contract. A booking may be made in writing or verbally (email, telephone, in person), but must always be received by the operator in writing by email and confirmed by the operator in the same form. The customer undertakes to contact the operator immediately after arrival on Bali to arrange payment.

3. Payment

Day tours (Tour 1 – Tour 7) can be paid on the day of the excursion directly to the guide.

For a multi-day round trip that includes hotel bookings, a deposit of 50 % of the total price is due at least 14 days before the start of the tour. The balance is due no later than 3 days before the start. After payment of the full amount, the customer receives an original voucher entitling them to the services stated on it. If the excursion price has not been paid in full by the contractually agreed start, the operator may cancel the booking and is released from its obligation to perform. The operator may also claim the applicable cancellation costs (see point 6) unless the customer has a right to withhold payment.

4. Payment methods / bank details

Under the Indonesian payment law of January 2016, all prices must be quoted in local currency (Indonesian rupiah). Customers may pay in foreign currency such as US dollars, euros or Swiss francs; the quoted price is converted at the daily rate. For transfers in euros, payment can be made to the operator's German or Austrian account – within the eurozone no transfer fees apply. Bank details are provided with the booking confirmation.

Any costs arising from a bank transfer are borne by the customer and may not be deducted from the invoice amount. The invoice amount for a transfer must reach the operator no later than 14 days before the start of the excursion.

5. Services / prices

The scope of the contractual services is determined by the programme description and the details on the original voucher. Bookings deviating from the programme are possible on request with individual pricing and must be made in writing. All prices include tax and are per person. Children up to their 6th birthday travel free (on multi-day round trips sharing the parents' room without an extra bed); from the 7th to the completed 12th year, 50 % of the total price is charged.

6. Withdrawal / cancellation and rebooking by the customer / substitutes

For day tours: A customer may be replaced by another person free of charge if notified in writing up to 2 days before the excursion. Rebooking requests regarding date and pick-up hotel must be notified in writing at least 2 days before the excursion and are accommodated free of charge. The flat cancellation fees are 75 % of the excursion price from 12 hours before the start and 100 % for no-shows. If a missed day tour is booked again later, only 85 % of the sale price is charged.

For multi-day round trips with hotel accommodation: A customer may be replaced by another person free of charge if notified in writing up to 10 days before the start; from the 9th day up to the day of departure, EUR 75.00 per person is charged. Written rebooking requests received up to 14 days before the start are handled free of charge where feasible. For later rebookings the following costs apply:

The minimum charge for a booking change is EUR 75.00 per booking. No-shows are charged 100 % of the excursion price.

7. Changes to services and prices

Changes and deviations to services are permitted insofar as the overall course of a booked tour is only insignificantly affected. In the event of substantial changes to hotel prices, fees, tariffs, taxes, exchange rates or similar, the operator may adjust the excursion price accordingly if more than one month lies between the conclusion of the contract and the agreed date. In that case the customer will be informed without delay, at the latest 21 days before the start. If an excursion price increases by more than 10 %, the customer may withdraw without compensation within 7 days of our notification. The withdrawal must be declared in writing and reach us no later than 10 days before the planned excursion.

8. Warranty / liability

If services are not provided as contracted, the customer may demand remedy. The operator may refuse remedy if it requires disproportionate effort. The operator may provide remedy by supplying an equivalent substitute service, provided this is reasonable for the customer, the defect was not caused deliberately and the remedy does not constitute an impermissible change to the contract. If a defect occurs, the customer must first notify the service provider without delay to allow immediate remedy; failing that, the customer must notify the operator's representative (tour guide) without delay. If the customer culpably fails to give notice of the defect, claims for price reduction and contractual damages are excluded. Termination of the booking contract because of a defect that substantially impairs a programme is only permissible if the operator fails to provide reasonable remedy within a reasonable period set by the customer.

9. Registering claims

If the customer wishes to assert claims against the operator arising from the travel contract or from tort, these must be registered with the operator (PT. BaliChakra Bhuwana Agung, Jalan Ganetri 9 D, Denpasar 80235, Bali – Indonesia) within one month of the contractually scheduled end of the excursion. Service providers, tour guides and other representatives are not authorised to receive claims. Contractual claims of the customer become time-barred after six months, beginning on the day the programme was scheduled to end. Assignment of claims against the operator is excluded.

10. Limitation of liability

The operator is liable for conscientious tour handling, careful supervision and selection of service providers (restaurants, hotels), the accuracy of the programme description and the proper provision of the contractually agreed services, taking into account local circumstances and customs. The operator's contractual liability for damage other than personal injury is limited to the simple tour price, provided the damage was caused neither intentionally nor through gross negligence. The operator recommends taking out travel accident and luggage insurance. For personal injury claims, the operator is liable under the conditions applicable in Indonesia.

11. Health requirements

Participating customers must be in normal health during the excursion. If a significant deviation – such as heart or lung conditions, severe diarrhoea, fever, another illness or pregnancy – is concealed from the operator, the operator is released from all liability.

12. Applicable law / jurisdiction

Indonesian law applies. The place of jurisdiction is Denpasar, Bali, Republic of Indonesia.

13. Website rights / use of the website
